Terms of order, payment, acceptance, warranty and return
1. General provisions
1.1. These Terms govern the ordering, payment, cancellation, acceptance, warranty and return of PRIVÉ TECH devices and services.
1.2. Every device is made to individual order: it undergoes irreversible hardware changes after which the phone cannot be sold as a regular one. Therefore, returns for reasons such as “changed my mind” or “not suitable” are not possible once work has started. This does not limit the buyer's rights in the event of a defect or non-conformity with the order.
1.3. The purpose of the device, the limits of its protection and the user's responsibility are described in a separate document, “Terms of Use and Limitation of Liability”. The two documents apply independently.
2. Two order formats
The terms depend on whose phone we modify:
Format A. “Turnkey”. We buy a new phone from an official reseller ourselves, modify it and hand the finished device over to you.
Format B. “Service on your phone”. You give us your own phone, new or used. We carry out only the selected work.
The format is set in the order. Sections 3 and 5 apply only to the turnkey format, section 6 only to the service on your phone, and the rest to both.
3. Turnkey format: intake inspection
3.1. After purchase and before any modifications, we carry out an intake inspection of the new device. We check: the integrity of the body and screen, display and touch operation, audio (speakers, microphones, headset connector or equivalent), modem, Wi-Fi and Bluetooth, storage and correct capacity reporting, battery, cameras and Face ID, the physical port, buttons and sensors.
3.2. The result is recorded in an intake inspection report (serial number, date, list of checks, photos or video). We provide a copy of the report on request.
3.3. If a factory defect is found during the intake inspection, we exchange the device with the reseller for a working one at no cost to you. The production time may shift as a result. If an exchange is not possible, you may cancel the order and we will refund the payment in full.
3.4. Until the intake inspection is complete and modifications have begun, the order is considered not yet in progress.
3.5. After the intake inspection, we record that the phone was in working order when modifications began. This allows any later faults to be attributed to a specific stage.
4. Payment and order cancellation
4.1. Payment is made strictly by invoice via bank transfer in the currency of your choice. The invoice is issued after the configuration is agreed and states the total price, the scope of work and the timeline.
4.2. You can pay the invoice from any bank, or via Wise or Revolut. Bank transfer fees are paid by the sender.
4.3. The order is paid in full (100%). Work begins once the payment has reached our account.
4.4. We do not accept payments from cards or accounts opened in the United States.
4.5. Before work begins (before the reseller purchase or, in Format B, before we receive your phone), you may cancel the order and receive a full refund.
4.6. After the device is purchased but before modifications begin, we refund the payment minus actual, documented expenses that could not be recovered from the reseller (bank fees, return logistics).
4.7. From the moment modifications begin, the order is considered in progress. The device is made to individual requirements, and it cannot be refused for reasons such as “changed my mind”, “not suitable” or “didn't feel the effect”.
5. Turnkey format: acceptance and claims
5.1. After the modifications, we re-check all functions that remain enabled and all modifications performed. The result is recorded in a completion report (list of modifications performed and device limitations).
5.2. On receipt, check the device and its contents, on video if possible. Report any claims within 7 calendar days of receipt to sales@privetech.io, stating exactly what does not work and attaching photos or video.
5.3. A defect is: a fault of the device that did not arise through your fault, or a mismatch between the modifications performed and your order.
5.4. The following are not defects:
- the absence of functions you chose to disable or remove (cameras, microphones, Face ID, SIM, cloud, sync, data transfer via the port, etc.);
- limitations expressly stated in the completion report;
- a feeling that you do not need the device or that it does not deliver the expected effect;
- damage caused through your fault (impact, moisture, self-opening, improper use).
5.5. What we do in case of a defect: at the seller's choice, we repair the fault free of charge, replace the device or refund the money. Claims are reviewed within 10 business days. Shipping costs for a confirmed defect are borne by us.
5.6. Our hardware modifications are covered by our 1-year warranty. The warranty does not cover the consequences of your interference, mechanical damage or use contrary to the instructions.
5.6.1. The warranty covers the hardware modifications performed. The software configuration (security profiles, iOS settings, apps and services) depends on decisions by Apple and third-party developers. If an iOS update changes or disables one of the functions, we will restore an equivalent configuration where technically possible, but we do not guarantee that it will be preserved.
5.7. If you used the Panic Wipe function or reset the device to factory settings, you received 100% of what you ordered: the function worked as intended. If you want the device set up again after a wipe, contact client service. The price is calculated based on the selected setup options with a 10% discount.
6. “Service on your phone” format
6.1. You confirm that you are the lawful owner of the phone and are entitled to hand it over for modification.
6.2. We are not responsible for the condition, origin or pre-existing defects of your phone. Before the work, we carry out diagnostics and record the condition in an intake report. If diagnostics show that the phone is not suitable for the selected modifications, we will tell you before work begins and you may withdraw (in this case, only the actual costs of diagnostics and return shipping are payable).
6.3. Modifications are irreversible. Work on a phone, especially a used or previously repaired one, carries a risk that the device or some of its functions will fail during the work or later. You accept this risk by confirming it when placing the order.
6.4. Backing up the data on your phone is your responsibility. Before handing the phone over, erase its data and remove it from your accounts (Apple ID, Find My iPhone, etc.).
6.5. Our liability for such an order is limited to the cost of the work performed. We are responsible for the work matching the order and for damage directly caused by our faulty actions. We are not responsible for faults unrelated to the work performed.
6.6. Returns for “changed my mind” are not possible once work has started. Before work begins, you may withdraw and take your phone back.
7. What you need to know about the device
7.1. The modifications void the manufacturer's (Apple) warranty. We provide the warranty on the work performed (clause 5.6).
7.2. Depending on the selected modifications, the device may have no cameras, microphones, Face ID, cellular connection, cloud services, wired connection to a computer, or the usual software update routine. The specific list is stated in your order and the completion report.
7.3. The purpose of the device, the limits of its protection, the rules of lawful use and the user's responsibility are described in the document “Terms of Use and Limitation of Liability”.
8. Legality and buyer responsibility
8.1. Before ordering, make sure that the device and the selected modifications are permitted in the country of delivery and use. Responsibility for the legality of ownership, import and use is described in the “Terms of Use and Limitation of Liability”.
8.2. The device is not intended for unlawful activity. We reserve the right to refuse an order if there are grounds to believe it is being placed for such purposes.
8.3. Customs duties, taxes and fees in the country of delivery are paid by the buyer unless otherwise stated in the order.
9. Data and privacy
9.1. We collect only the data needed to fulfil the order (contact, delivery address, list of selected work). We do not access or store the contents of your device.
9.2. Order data retention: order data is deleted from operational databases 30 days after delivery and acceptance of the device by the client are confirmed.
10. Seller and contacts
Information security for businesses and individuals “PRIVÉ TECH” is the name under which a sole proprietor (FOP) registered in Ukraine operates. The seller's full details are stated in the invoice and provided on request.
